Introduction
AGILI Art Studio and its affiliates (“AGILI”) have a reputation for providing high-quality Artwork, products and services. AGILI’s trademark is an important asset and AGILI requires that it is used properly. To preserve its reputation and protect its trademark, AGILI diligently guards against any violation of its trademark. AGILI acknowledges the desire of third parties to show affiliation with AGILI. Without written permission from AGILI, however, you should not use AGILI’s trademark, service marks, or names in a manner that suggests affiliation or association with AGILI. Only parties with written permission from AGILI are allowed to use AGILI’s trademark in accordance with applicable terms.
AGILI Trademark maintains a portfolio, which take various forms and may include letters, words, logos, designs, images, slogans, colours, product shapes, product packaging, and at times sound. Please refer to the “Trademark” link at the bottom of any AGILI Art Studio webpage for a listing of AGILI products. Please note, however, that this listing is not all-inclusive and the absence of any mark on this list does not mean that it is not an AGILI trademark. Certain activities may constitute infringement or dilution of AGILI’s trademark and are not permitted. Please review the following list of ways to avoid unauthorized use of AGILI’s trademark:
• Do not use a AGILI trademark or name in a manner that is likely to cause confusion about the origin of any product, service, material, course, technology, program or other offerings.
• Unless you have prior permission from AGILI, do not use a AGILI trademark or name in a manner that is likely to give the impression or otherwise imply an affiliation or association between you, your products or services, and AGILI, or any of its products, services, programs, materials, or other offerings.
• Do not use the AGILI corporate logo or any other AGILI logo in any materials without the written permission of AGILI ART STUDIO and Agnes Parcesepe and/or her Management Team.
• Do not use any AGILI trademark or name as or as part of a company, product, service. • Do not use a AGILI trademark or name in a manner that is likely to dilute, defame, disparage, or harm the reputation of AGILI ART STUDIO and its Affiliates.
• Do not use any trademark, name, or designation that is confusingly similar to the AGILI name or any AGILI trademark under classification no 16 of Australian Intellectual Property Organisation.
• Do not copy or imitate any AGILI trade fabrics, type style, logo, product packaging, or the look, design, or overall commercial impression of any AGILI website, blog, or other material.
• Do not register or use any domain name that incorporates any AGILI mark or name.
• Do not register or seek to register a AGILI trademark or name, or any mark or name that is confusingly similar to a AGILI mark or name as it will be subject to Opposition.
AGILI Logo
Unless you have prior written permission from AGILI, do not use the AGILI corporate logo to show or imply an affiliation with AGILI. Qualified third parties can show an affiliation or association with AGILI through AGILI’s authorized programs.
Permissible Use
As stated above, you should not use AGILI’s mark or name in any way that implies an association or affiliation with AGILI unless you have prior permission from AGILI. AGILI does grant permission to third parties to use its mark and name where appropriate. In addition to complying with the other aspects of this Policy, and
provided you have prior written permission from AGILI, any such permissible use of AGILI’s mark or name must comply with the following Guidelines and any license or usage requirements for use of the specific mark or logo. AGILI acknowledges that the use of AGILI trademark, excluding any AGILI logos, may be necessary to refer to AGILI’s products or services or to describe the subject matter of some materials, products, and/or programs. All such use must be accurate and descriptive in nature and comply with this Policy and these Guidelines.
• Do not alter, adapt, modify, animate, or morph any AGILI trademark. Examples of what not to do include abbreviating or shortening a trademark (for example, AGILI to C), combining or hyphenating a trademark with another prefix or word (for example, AGILI-led), or using a slash mark with any trademark (for example, AGILI/My Trademark or Product).
• Do not use the AGILI name or AGILI trademark next to your name or the name of your products or services.
• Do not use the AGILI name or any AGILI trademark as part of a product, service, solution, or program name.
• Do not combine any AGILI name or mark with any other letters, numbers, words, or any design or logo.
• Do not use any AGILI name or trademark as the visual focal point of any materials.
• The AGILI name or AGILI trademark must not be more prominently displayed than your name or your product or service name.
• The AGILI name or AGILI trademark must be visually distinguishable from your name and your product and service names.
• All reference to AGILI or use of any AGILI mark or name must be truthful, accurate, and not misleading.
• Do not use AGILI’s trademark as a noun. AGILI’s trademark must be used as adjectives with nouns that properly and accurately identify the AGILI artwork products, services, programs, materials, or technology to which you are referencing.
• Always use the proper spelling for AGILI’s trademark.
• Do not use a AGILI trademark in the plural or possessive form.
Plural example:
Do not say: The AGILIS artworks.
Possessive example:
Do not say: AGILI artwork’s unique look. Do say: The unique look of a AGILI artwork.
• Do not use AGILI’s mark or name in any way they were not intended to be used. AGILI’s mark should be used for the corresponding product or services for which they were originally intended.
• Use the ® or ™ symbol in connection with any AGILI trademark and the following acknowledgement of AGILI’s ownership of its mark and/or logo:“[insert permissible mark] [is a/are] registered trademark[s] or trademark[s] of AGILI and/or its affiliates in Australia and certain other countries.”
